The State Department of Environmental Conservation and State Department of Health have issued an advisory for the pollutant, ozone, from 11:00 a.m. to 11:00 p.m. today.

The state issues Air Quality Health Advisories when DEC meteorologists predict levels of pollution, either ozone or fine particulate matter, are expected to exceed an Air Quality Index (AQI) value of 100.

Hot and sunny weather can lead to the formation of ground-level ozone, a major component of photochemical smog. Automobile exhaust and out-of-state emission sources are the primary sources of ground-level ozone and are the most serious air pollution problems in the northeast.

People, especially young children, those who exercise outdoors, those involved in vigorous outdoor work, and those who have respiratory disease (such as asthma) should consider limiting strenuous outdoor physical activity when ozone levels are the highest (generally afternoon to early evening).

When outdoor levels of ozone are elevated, going indoors will usually reduce your exposure. Individuals experiencing symptoms such as shortness of breath, chest pain or coughing should consider consulting their doctor.

Ozone levels generally decrease at night and can be minimized during daylight hours by curtailment of automobile travel and the use of public transportation where available.

Governor Kathy Hochul signs abortion rights package (June 13, 2022)

Governor Kathy Hochul has announced that the State will stockpile an abortion medication as part of ongoing efforts to protect access to abortion.

At the Governor’s direction, the New York State Department of Health will immediately begin purchasing Misoprostol in order to stockpile 150,000 doses, a five-year supply, in order to meet anticipated needs.

A federal judge in Texas ruled on April 7 to reverse the U.S. Food and Drug Administration‘s approval of mifepristone, an oral medication typically taken with misoprostol to end a pregnancy.

Conservative Christian legal advocacy group, Alliance Defending Freedom, requested the reversal in a lawsuit that said mifepristone is unsafe and that the FDA didn’t study it closely enough before approving its use. The FDA and mainstream medical doctors insist this isn’t true, and that there have been no safety concerns during the 23 years the drug has been on the market.
An injunction by the federal judge to ban mifepristone starting April 14 may impact as many as 64 million women of childbearing age in the U.S.

Hocul issued a statement saying, “Anti-choice extremists have shown that they are not stopping at overturning Roe, and they are working to entirely dismantle our country’s reproductive health care system, including medication abortion and contraception. New York will always be a safe harbor for abortion care, and I am taking action to protect abortion access in our State and continue to lead the nation in defending the right to reproductive autonomy.”

Hochul also announced that if the abortion medication Mifepristone is taken off the market, the State will commit up to an additional $20 million to providers to support access to other methods of care.

To further safeguard access to abortion medication, Hochul is also currently working with the State Legislature on new legislation to require private insurers to cover Misoprostol when it’s prescribed off-label for abortion and to ensure that no provider is charged increased medical malpractice coverage rates or loses coverage due to prescribing Misoprostol off-label.

Dr. James McDonald

Governor Kathy Hochul has announced the nomination of Dr. James McDonald to serve as Commissioner of the New York State Department of Health.

Dr. McDonald has been serving as New York’s Acting Commissioner of Health since January 1.

He is a native New Yorker who is originally from Cohoes and received his bachelor’s degree from Siena College. Dr. McDonald earned his M.D. from Loyola Stritch School of Medicine in Chicago, his pediatric residency in the U.S. Navy, and his preventive medicine residency from the State University of New York. He earned his MPH from the University of North Carolina in Chapel Hill and earned his B.S. in Biology from Siena College. Dr. McDonald is board certified in pediatrics as well as preventive medicine.

He joined the New York State Department of Health in July of 2022, serving as medical director of the Department’s Office of Public Health. He later was appointed Interim Director of the Center for Community Health.

Narcan

The U.S. Food and Drug Administration has approved selling naloxone over the counter.

The drug would be the first opioid treatment drug to be sold without a prescription.

In New York State, residents can already obtain Narcan from a pharmacy without a prescription thanks to a standing prescription order from the State Department of Health.

The drug can reverse overdoses of opioids, including street drugs such as heroin and fentanyl and prescription versions including oxycodone.

The FDA sees making naloxone available more widely as a key strategy to control the nationwide overdose crisis, which has been linked to more than 100,000 U.S. deaths a year

Emergent BioSolutions, the company that makes Narcan, said they expect the drug will become available over-the-counter by late summer. Other brands of naloxone and injectable forms will not yet be available over the counter, but they could be soon.

Several manufacturers of generic naloxone that’s made similarly to Narcan will now be required to file applications to switch their drugs over the counter as part of a requirement by the FDA.

The State Attorney General’s Office has appealed a State Supreme Court ruling that said the State Department of Health exceeded its authority by using rulemaking process for isolation and quarantine procedures.

The lawsuit against the State Department of Health had been brought by State Senator George Borrello and others in regards to the enactment of a state DOH regulation that establishes isolation and quarantine procedures for those who are suspected of having a communicable disease. The proposed regulation was adopted as an emergency regulation on February 22, 2022 and has been renewed at 90-day intervals through July 20, 2022. It has also been published in the New York State Register for permanent adoption through the rulemaking process.

The proposed rule would allow the Health Department to coordinate with a local health authority to mandate isolation and quarantine for individuals exposed to communicable diseases, even in locations beyond their own homes.

Cattaraugus County State Supreme Court Judge Ronald Ploetz issued a ruling on July 8, 2022 that cited the fact that there is already established Public Health Law governing isolation and quarantine which balances individual rights and the need for public safety.

He notes that in Rule 2.13 there is “no such due process protections…The Commissioner has unfettered discretion to issue a quarantine or isolation for anyone, even if there is no evidence that person is infected or a carrier of the disease… Involuntary detention is a severe deprivation of individual liberty, far more egregious than other health safety measures… Rule 2.13 merely gives “lip service” to Constitutional due process.”

In response to the state’s appeal, State Senator George Borrello issued a statement saying the state’s appeal is “disappointing, but not a surprise,” calling their actions, “.. an egregious waste of taxpayer dollars and an attempt to defend an indefensible policy. The constitutional separation of powers and the right of due process are principles that cannot be compromised.”

Norm Green addresses Chautauqua County Legislature (February 22, 2023)

The Chautauqua County Legislature is urging New York State to release funds to help get a new Brooks Memorial Hospital constructed.

The Legislature unanimously passed a motion requesting Governor Kathy Hochul release the $74 million toward the project.

Former Democratic Board of Election Commissioner and County Democratic Committee Chair Norm Green spoke at privilege of the floor, calling the project the biggest issue in Chautauqua County, “This isn’t a Dunkirk problem. It’s not a Fredonia problem. It’s not a Brocton problem. It’s not a Silver Creek problem. It goes way beyond those borders and only the County of Chautauqua can be the ones who assist. So I hope tonight, after you pass this motion, that the work won’t stop.”

Green brought up the idea that the County should even consider taking over the hospital.

Legislator Kevin Muldowney said he agreed with Green’s comments, which is a rare thing, and that it’s vital the legislature presents a united front in asking governor to release the funds issued in 2016, “It’s an economic development motivator. If we do want to recruit and continue to recruit businesses into Chautauqua County, we have to have a viable, state of the art hospital. And this is a regional issue. Stop thinking parochial and start thinking regional.”

Muldowney said access to a hospital is also important for north county residents from a safety standpoint.

County Executive PJ Wendel said in his monthly interview with WRFA that his biggest fear is that the state will release the funds for the construction of the hospital, and then the money will run out, “The model has some questions, as far as their sustainability financially. And my biggest concern is that they get the funding and the monies run out and the hospital isn’t finished. You know, prior to this large sum of money that Governor (Andrew) Cuomo first put aside from Brooks, and now Governor (Kathy) Hochul has it as well, they were supporting Brooks quite substantially, the Department of Health, with funding for two years prior to that.”
Wendel said the state required that the hospital have a sustainable financial model moving forward, which he doesn’t believe has been presented.

He said the blue ribbon task force he formed with Dunkirk Mayor Willie Rosas, State Senator George Borrello, Assemblyman Andy Goodell, and numerous health experts have worked with Brooks Hospital officials on moving forward with the proposed new hospital building.

Wendel added the hospital board is aware of the guidelines set by New York State and that they shoulder the responsibility in getting a completed plan to them.

Narcan

The FDA is considering making naloxone available over the counter in the United States.

Naloxone is a life-saving medication that can reverse an overdose from opioids, including heroin, fentanyl, and prescription opioid medications,, when given in time.

The panel of Food and Drug Administration experts voted unanimously last week in favor of the switch after a full day of presentations and discussions centered on whether untrained users would be able to safely and effectively use the nasal spray in emergency situations.

According to the National Institute on Drug Abuse, over 106,000 people died of opioid-related overdoses in 2021.

Mental Health Association in Chautauqua County Executive Director Steven Cobb is enthused about the news and said it will help remove stigma, “When you make something over the counter, I think it shows to a broader bunch of people that it’s safe to use and that people can handle using it. And it also makes Naloxone, or Narcan, which is a brand name, just available to a larger segment of the population.”

Cobb said people in New York can already obtain Narcan from a pharmacy without a prescription thanks to a standing prescription order from the State Department of Health, “New York State will cover the co-pay for your insurance, whether it’s private pay insurance or whether it’s Medicaid or Medicare. The pharmacist will put it through on your prescription and then New York State will cover the co-pay for three boxes of Narcan per year per New York State resident.”

Cobb said if the FDA approval goes through, he’d like to see Narcan made available through vending machines anywhere people who use substances gather, including health facilities, libraries, bars, and more.

He stressed that Narcan is not a drug that can be abused, “Unless you have opiates in your system, Narcan will have no effect on you. And there’s no ability to get high. You can’t be poisoned by Narcan. It’s a very safe drug to use for the community, to feel comfortable using, safety-wise there are no issues.”

A vote on the matter by the FDA is expected by the end of March.

UPMC will receive $29,841,205 for capital improvements to expand and consolidate surgical services.

TCC will receive $1.25 million to purchase three existing primary care facilities in Dunkirk, Gowanda, and Forestville.

The funding being administered by the State Department of Health and the Dormitory Authority of the State of New York is supposed to help improve patient care by supporting high-quality facilities serving the in-patient, primary care, mental health, substance use disorder and long-term care needs of communities throughout the state.

The state Department of Health announced Friday that the mask mandate would expire Sunday, February 12. Health care facilities will be able to craft their own masking rules based on CDC guidance that takes local case counts, COVID transmission levels, and open hospital beds into account.

The CDC dropped its mask requirement for health care facilities last fall.

The latest from the DOH does not affect any facility requirements unrelated to COVID-19, including those in place for Influenza.

WRFA contacted UPMC Chautauqua and The Chautauqua Center on whether their mask requirements have changed.

Only TCC responded, stating they are not changing their masking policy. Masks are still required at TCC, Chautauqua PT & OT, and Tri-County Family Medicine until further review and notice.

The Chautauqua County Department of Health and Human Services (CCDHHS), Brooks-TLC Hospital System, Inc., UPMC Chautauqua and Allegheny Health Network Westfield were part of a greater Chautauqua County Community Health Planning Team that completed the plan.

The Community Health Assessment is done in conjunction with the New York State Department of Health (NYSDOH) Prevention Agenda.

The assessment researched data trends in Chautauqua County, compared data trends across New York State, and provided a plan for the upcoming years to improve public health concerns.

The top four family and/or community health issues identified as concerns in Chautauqua County’s Health Survey were:

– Medical health (heart disease – high blood pressure, stroke, heart attack; diabetes; obesity; cancer; asthma; chronic lung disease; chronic pain management; etc. (75.55%),
– Mental health (stress; anxiety; depression; suicide; etc.) (66.52%),
– Environmental safety (food/water, neighborhood; roadway; safe and clean housing; etc. (56.75%),
– And drug/alcohol use disorders (49.45%).

The top four suggestions that might help communities make healthy choices and changes identified in the Community Health Survey were:

– Having groups in the community that encourage healthy habits (physical activity, nutrition, stress reduction, diabetes prevention, fall prevention, quitting tobacco/nicotine, etc. (53.48%),
– Having safe areas to play and exercise in the community (51.86%),
– Having more healthy food choices at local convenience stores (48.79%),
– And getting information about how to make healthy changes from social media, internet, newspapers and TV (44.05%).

All hospitals and the County Health and Human Services Department have agreed to collaborate to address the Prevent Chronic Diseases priority area with a focus on Tobacco Prevention. They also plan to work to decrease the prevalence of tobacco use by adolescents.

The plan states they also will work collaboratively with the Chautauqua County Department of Mental Hygiene in the area of Mental and Substance Use Disorders to prevent opioid deaths by increasing the availability and accessibility of Narcan.

Additionally, the County Health Department’s Environmental division will work to Promote a Healthy and Safe Environment by increasing the number of homes tested for radon and increasing educational efforts to increase blood lead testing rates.

And under the priority of “Promoting Healthy Women, Infants and Children” the group will focus on addressing the areas of perinatal and infant health (by increasing breastfeeding) and maternal and women’s health by enhancing collaboration with other programs, providers, agencies, and community members to address key social determinants of health that impact the health of women, infants, children, and families across the life course
