In early 2017, Swanson announced his office would take a hard-line approach when prosecuting individuals who’ve been arrested on illegal gun-related charges. He said his “Gun Done” policy would involve not accepting any plea deals on gun charges.

Among those who were sentenced for gun-related charges were James Blue of Jamestown, who was sentenced on Feb. 26 to a determinate sentence of four years in State Prison after being convicted on one count of Criminal Possession of a Weapon in the 2nd Degree. Blue was arrested on June 5, 2017 for possessing a loaded FNH 40-cal pistol that was reportedly stolen from Cattaraugus County.

In another Gun-Done case, 29 year old Michael Thompson of Bemus Point was sentenced to three and a-half years in state prison after being convicted on one count of Criminal Possession of a Weapon in the 2nd Degree. Thompson was arrested and charged in January 2017 following an investigation into an automobile accident in the Town of Ellery, when an assault rifle with numerous loaded magazine, a sawed off shotgun, commercial and homemade fireworks, and throwing stars were all recovered.

Also sentenced was 18 year old Eduardo Rivera of Jamestown, who was sentenced in February to a determinate sentence of three years in state prison after being convicted on one count of Attempted Criminal Possession of a Weapon in the 2nd Degree.  The Court did not grant youthful offender status.

And 38 year old Jennifer MacGonigal of Chagrin Falls, OH was sentenced in December to two and a-half years in state prison after being convicted of Attempted Criminal Possession of a Weapon in the 2nd Degree.

In addition to the Gun-Done cases, Swanson announced nine other recent sentences:

• Sean Barret, of Jamestown, NY, was sentenced on Feb. 22, 2018 by Judge John LaMancuso to a determinate sentence of two years in State Prison and one year of post-release supervision after being convicted on one (1) count of Criminal Possession of a Controlled Substance in the 5th Degree.
• Joseph J. Thayer, 41, of Jamestown, NY, was sentenced on Feb. 26, 2018 by Judge David Foley to a determinate sentence of one year plus one year post-release supervision after being convicted on one count of Criminal Possession of a Controlled Substance in the 5th Degree.
• Jeffrey D. Switzer, 33, of Fredonia, NY, was sentenced on Feb. 22, 2018 by Judge Paul Wojtaszek to two determinate sentences of three and one-half years in State Prison plus two and one-half years of post-release supervision after being convicted on two counts of Burglary in the 2nd Degree. Those sentences were ordered to run concurrently to one another.
• Eric L. Reese, 31, of Jamestown, NY, was sentenced on Feb. 15, 2018 by Judge David Foley to two determinate sentences of two and one-half years in state prison plus one year of post-release supervision after being convicted of Criminal Possession of a Controlled Substance in the 5th Degree. Those sentences were ordered to run concurrently to one another.
• Daniel R. McKay, 24, of Jamestown, NY, was sentenced on Feb. 5, 2018 by Judge David Foley to a determinate sentence of eight years plus three years of post-release supervision after being convicted of Attempted Criminal Possession of a Controlled Substance in the 3rd Degree.
• Bernard E. Mount, 36, of Jamestown, NY, was sentenced on Feb. 1, 2018 by Judge John LaMancuso to an indeterminate sentence of one and one-third years to four years in state prison after being convicted of Burglary in the 3rd Degree.
• Michael Melendez-Payne, 38, of Jamestown NY, was sentenced on Jan. 22, 2018 by Judge David Foley to three years in state prison plus two  years of post-release supervision after being convicted oCriminal Possession of a Controlled Substance in the 4th Degree.
• Jason W. Thorn, 38, of Jamestown, NY was sentenced on Jan. 22, 2018 by Judge David Foley to an indeterminate sentence of one and one-third years to four years in state prison after being convicted of Criminal Possession of a Weapon in the 3rd Degree.
• Dishawn L. Mays, 31, of Rochester, NY was sentenced on Jan. 8, 2018 by Judge David Foley to a determinate sentence of two years in state prison plus one year of post-release supervision after being convicted of Criminal Possession of a Controlled Substance in the 5th Degree.

Specific incident details on each of the cases were not provided by the DA’s office.

Chautauqua County sheriff’s deputies say the crash occurred just before 2 a.m. on Route 380 at Pickard Rd. Sinclairville, NY. for a vehicle that had struck a utility pole. While looking inside the unoccupied vehicle through smashed-out windows, sheriff’s deputies observed an assault rifle with numerous loaded magazine, a sawed off shotgun, commercial and homemade fireworks, and throwing stars.

An investigation led to 29-year-old Michael Thompson being found at a near-by residence. He was taken into custody and charged with DWI; DWI per se (Misdemeanor); Criminal Possession of a Weapon – 3rd Degree for  possession of an assault weapon with large capacity ammunition feeding devices – 8 magazines (D-Felony); Criminal Possession of a Weapon – 4th Degree – five throwing stars (A-Misdemeanor); and Unlawful Possession of Fireworks (B-Misdemeanor).

Thompson was arraigned in Ellery Town Court, where bail was set at $75,000 cash and sent to the county jail.
