NY Governor Kathy Hochul celebrates being elected the state’s first woman governor

Democrat Kathy Hochul has been elected the first woman governor of New York State.

Hochul defeated Republican Lee Zeldin with 52% of the vote.

It was a sweep for the Democrats in statewide elections in New York.

Incumbent Democrat State Attorney General Letitia James has been declared the winner against Republican Michael Henry. Incumbent Democrat Comptroller Tom DiNapoli also won re-election over Republican Paul Rodriguez.

U.S. Senator Chuck Schumer was re-elected to a fifth term over Republican Joe Pinion.

In the race for the new 23rd Congressional District, Republican Nick Langworthy declared victory over Democrat Max Della Pia.

In State Legislative races, Republican State Senator George Borrello has defeated Democrat Dan Brown and Republican Assemblyman Andy Goodell won re-election against Democrat Sandra Lewis.

In the special election for Chautauqua County Legislative District 13, incumbent Republican John Penhollow won with 1,600 votes over Democrat Barbara Colt who received 600 votes.

For the special election in the City of Jamestown for the Ward 5 Council Seat, Republican incumbant Bill Reynolds received 751 votes over Democrat Doug Lawson‘s 486 votes.

For the five 8th Judicial State Supreme Court Justice seats open, Craig Hannah, Tracey Bannister, Kelly Vacco, Gerald Greenan III, and Joseph Lorigo were elected. Shannon Heneghan lost that race.

The State proposition to authorize New York State to borrow $4.2 billion for the Clean Water, Clean Air, and Clean Jobs Environmental Bond Act was approved by voters. The monies will go toward funding environmental protection, natural restoration, resilience, and clean energy projects.

Governor Kathy Hochul is attempting to secure a full four-year term on the Democratic and Working Families line against Republican and Conservative endorsed candidate Lee Zeldin. Zeldin currently is the 1st Congressional District Representative. Hochul took over as Governor following Andrew Cuomo‘s resignation in August 2021. For the Lieutenant Governor’s race, Antonio Delgado is running with Hochul and Alison Esposito is running with Zeldin

Voters from Chautauqua County across to Stueben County and now part of Erie County will vote on a new representative for the new 23rd Congressional District. Republican Nick Langworthy is facing Democrat Max Della Pia for that seat. The pre-2020 census district was formerly led by Tom Reed for the last 10 years and is currently represented by Joe Sempolinski.

Longtime incumbent and Democrat Chuck Schumer is running for re-election against Republican Joe Pinion and LaRouche party candidate Diane Sare.

Two other statewide offices on the ballot include incumbent State Attorney General Letitia James on the Democratic and Working Families line facing Michael Henry on the Republican and Conservative lines.

And incumbent State Comptroller Thomas DiNapoli on the Democratic and Working Families lines is facing Paul Rodriguez on the Republican and Conservative lines.

In State Legislative races, incumbent State Senator George Borrello is running on the Republican and Conservative lines for the 57th District against Dan Brown on the Democratic line. Incumbent Assemblyman Andy Goodell is also running on the Republican and Conservatives lines against Democrat Sandra Lewis.

In Chautauqua County races, the County Sheriff race is unopposed with incumbent Jim Quattrone running on the Republican and Conservative lines.

There are two special elections for the Chautauqua County Legislature.

In District 7, incumbent John Penhollow is running on the Republican and Conservative lines against Barbara Colt who is running on the Democratic and Working Families lines. Penhollow was appointed to fill the seat after Mark Odell resigned in July 2021.

In District 10, Republican incumbent Jaime Gustafson is running unopposed. She was appointed to fill the seat after Ken Lawton resigned due to moving out of the district. District 10 represents the southwest side of Jamestown, the Village of Lakewood and part of the Town of Busti.

In the City of Jamestown, a special election for the Ward 5 City Council seat is being held between incumbant Bill Reynolds on the Republican and Conservative lines and Democrat Doug Lawson. The winner of that race will fill out the remainder of that seat’s term following Grant Olson declining to take the seat after the 2021 election.

There are five seats open for the 8th Judicial State Supreme Court Justices. Running on all four lines of Democratic, Republican, Conservative and Working Families is Craig Hannah. Kelly Vacco and Gerald Greenan III are running on the Democratic, Republican, and Conservatives lines. Shannon Heneghan is running on the Democratic and Working Families lines. And Joseph Lorigo is running on the Republican and Conservatives lines.

There is one proposition located on the back of the ballot.

The Clean Water, Clean Air, and Clean Jobs Environmental Bond Act would, if approved, authorize New York State to borrow $4.2 billion to fund environmental protection, natural restoration, resilience, and clean energy projects.

The State Legislature has already approved the plan, which allows the state to sell the bonds immediately after approval. But in order to sell the bonds, the state has to get approval from voters.

Polls are open Tuesday from 6 a.m. until 9 p.m. in Chautauqua County.

District 10 Legislator Jamie Gustafson introduces herself to the County Legislature (July 27, 2022)

The Chautauqua County Legislature has approved a 19-district reapportionment map, but voted down sending it to referendum in November.

A local law establishing a 17-district map failed in a vote of 3 to 14 with Legislators John Penhollow and Paul Whitford being absent. Only Legislators Bob Bankowski, Susan Parker, and Billy Torres supported the reduction.

Proponents of the 17-district plan included local League of Women Voters representative Mary Croxton who spoke at the public hearing saying with the over 5% decrease in population from the last census, keeping the same number of legislators makes less sense, “We need to be more efficient and cost effective as a county government. Maintaining the same number of legislative districts with all of the technical and economical challenges that we have taken place and are expected to take place over the coming decade is not efficient or cost effective. Chautauqua County residents and the taxpayers cannot afford the status quo.”

County Reapportionment Co-Chair Larry Wilcox spoke in opposition to the 17-district plan, saying the plan would divide more rural towns into different election districts than the 19-district plan, which would only divide two towns, “One-third of the small towns in this county are divided into two or more legislative districts under the 17-member plan. That’s one of the reasons the 19-member plan, which I encourage you to adopt, is far superior to the 17-member plan. The people in this rural area would have their voting power diluted under the 17-member plan, but it would be intact under the 19-member plan.”

The local law setting a 19-district map passed 14 to 3 with Legislators Bankowski, Parker, and Torres voting against it. A resolution to have a referendum on the 19-district map failed along the same lines in a vote of 3 to 14.

The Legislature approved the appointment of Jamie Gustafson to lead Legislative District 10. She replaces Ken Lawton, who has moved out of the district. Legislator Gustafson has lived in the district with her family for 30 years and is employed by M&T Bank. District 10 represents the southwest side of Jamestown, the Village of Lakewood and part of the Town of Busti.

The Legislature approved a local law by a vote of 12 to 5 to create a Chautauqua County Landfill Commission.

Public Facilities Deputy Director Aaron Gustafson, speaking at privilege at the floor, stated concern over why the Commission was being proposed. He stated that the doors of communications work both ways, “We do not feel that the added level of government, the commission, will solve anymore issues than the current processes that are already in place, especially given the concerning involvement of private interest that are proposed to be part of the commission. We fail to see how private business members would help foster better communication between the division and this legislative body. In fact, it seems it most certainly would create an environment for conflicts of interest.”

Legislator Susan Parker proposed two separate amendments that would have added language not allowing the commission to entertain privatizing landfill operations and also would not allow private customers as members of the commission. Both proposed amendments failed. Legislators Parker, Bob Bankowski, and Elisabeth Rankin cited concern about conflicts of interests from private businesses and that concerns about the Landfill could be handled with existing means of communication.

The commission will have seven members appointed by the County Executive including two County Legislators as well as representatives of the government of the Town of Ellery, a large municipal customer, a large private customer, a waste hauler, and a representative of a community hosting a County transfer station.

Chautauqua County Legislature Oath of Office (1/3/2022)

Four new legislators were sworn in at the Chautauqua County Legislature‘s organizational meeting Monday.

Republican Marty Proctor replaced Bill Ward in District 18 with Dave Wilfong replacing Bob Whitney in Jamestown District 11. Both Procter and Wilfong had previously served on the Legislature. Democrat Billy Torres replaced Chuck Nazzaro in Jamestown District 9. Nazzaro had chose not to run again. Democrat Susan Parker replaced Christine Starks in Fredonia District 4.

The legislature also voted to replace Mark Odell on the Legislature with John Penhollow of Sinclairville. Odell had resigned in July after moving out of the district, but his name remained on the ballot. Penhollow was appointed to fill his term last year.

Legislator Pierre Chagnon was unanimously elected the chair of the Legislature.

The legislature approved the reappointment of Ned Barone as Public Defender. The appointment is a 2-year term.

They also appointed Olivia Lee as the new Clerk of the Legislature. Lee replaces Kathy Tampio, who is retiring after 10 years as Clerk. Legislator Chagnon and County Executive PJ Wendel presented Tampio with a commendation for her service at the meeting.

The body will vote to reappoint Ned Barone as Public Defender. The appointment is a 2-year term.

The legislature also will vote to replace Mark Odell on the Legislature with John Penhollow of Sinclairville. Odell had resigned in July after moving out of the district, but his name remained on the ballot. Penhollow was appointed to fill his term.

Other resolutions include the appointment of the chair of the Legislature. Pierre Chagnon has served in that role and is expected to be reappointed. There will be a resolutions to appoint Legislator Tom Harmon as Majority Leader with Lisa Vanstrom appointed as Assistant Majority Leader. Legislator and Democrat Bob Bankoski will be voted on to be Minority Leader with Jamestown Legislator Paul Whitford as Assistant Minority Leader.

The organizational meeting will take place at 4pm in Legislative Chambers in the Gerace Office Building in Mayville.

County Legislature Honors Outgoing Legislator Chuck Nazzaro

The Chautauqua County Legislature has approved a local law increasing salaries for the Undersheriff, Captain, Warden and Corrections Lieutenant.

Legislator Terry Niebel said when the local law was introduced he asked the County Sheriff and Human Resources to research salary information in other counties for comparison, “They ended up looking at 32 other counties. The salary range before us now puts us somewhere in the middle of those 32 counties. We are looking at an increase of two or three ranges for each position. But given today’s situation with law enforcement, I believe these increases are warranted.”

The local law passed unanimously.

A resolution to increase landfill and transfer station fees also passed by a vote of 16 to 2. Legislators Bill Ward and John Penhollow were the two votes against. The new fees go into effect January 1st.

Legislators approved by block vote a host of resolutions that included several resolutions that adjusted American Rescue Plan funding toward emergency services department projects. Legislator Chuck Nazzaro said while the resolutions were being handled quickly by the full legislature, that they were discussed thoroughly in committee, “As you know, we received $24.6 million in ARPA funding, the American Rescue Plan. And to date, now with what we have before us tonight we will have approved just under $10.2 million in projects. So each year we receive $12.3 million for 2021 and $12.3 million for 2022 and we’ve spent or awarded $10.2 million today.”

Legislature Chairman Pierre Chagnon presented outgoing Legislators Christine Starks, Chuck Nazzaro, Bob Whitney, and Bill Ward with commendations for their time and service on the Legislature.
Memorials also were read for former County Legislators who died this past year including Ron Szot, Vickye James, Mac Crowe, Bob Duff, and Tom Harte.

The next County Legislature meeting will be its organizational meeting at 4pm, Monday, January 3, 2022.

Deputies say 24-year-old John Penhollow was swimming Friday afternoon with two friends in Barcelona Harbor in a restricted area between two break walls. Rescue crews were called to the area just before 4:30 p.m. when Penhollow didn’t come back up to the water surface. His body was recovered around 6:30 p.m.

The area of Barcelona harbor has been known to have a strong undercurrent and has claimed lives in the past due to drowning, which is why the area is restricted from swimming.

JAMESTOWN – A group of concerned residents will be at the James Prendergast Library this afternoon to express their concerns regarding possible changes in services. The group is will attend today’s Friends of the Prendergast Library meeting in the library’s Fireplace Room.

Some of the concerns include the executive director Linda Mielke’s 2012 operating budget. A member of the group claims the budget is calling for the cancellation of an estimated 80 magazine titles, discarding reference books to make room for DVDs, and a reduction in non-fiction spending while increasing the amount being spent on fiction. The group will also express their interest in preserving a mural that currently sits in the Children’s Room at the library.

Today’s meeting is open to the public. It begin at 5 p.m. in the library’s Fireplace Room.

JAMESTOWN BIKE, PEDESTRIAN PLAN MOVING FORWARD

JAMESTOWN – The city of Jamestown is on its way to becoming a better and safer place for pedestrians and bicyclists. That’s according to the consulting firm Pashek from Pittsburgh, who is working with the Chautauqua County Health Network to create a pedestrian and bicycle plan that not only makes it safer for current walkers and riders – but would also encourage others to take part in walking or riding as well. Its part of the Chautauqua County Health Network’s  Creating Healthy Places initiative.

Monday night, officials from Pashek updated the members of a steering committee charged with overseeing the development and completion of a City of Jamestown Pedestrian and Bicycle Plan.  Among the issues discussed were an effort to target areas with safety concerns in the city, as well as locating the primary bicycle routes through the city so that they can be improved for better bicycle use.

Creating Healthy Places Project Coordinator Janet Forbes says she is pleased with the work Pashek has done so far, including the research they’ve done to develop the plan. Health Network executive Director Anne Abdella also reminds resident that while this plan is new, it is also building off of several others that have been developed in recent years, which also directly or indirectly addressed bicycling and walking issues.

Members of the steering committee will spend the next couple of weeks fine-tuning the plan. Once they’ve provided their input, the plan will then be put forward for public review, where members of the community can offer their input into the process.

CITY SEEKS STATE’S APPROVAL FOR INCREASING CERTIFICATE REPRODUCTION FEES

JAMESTOWN – The city of Jamestown is hoping New York State will make quick work of a request that was approved last night by the city council. City lawmakers approved a resolution last night requesting the state grant permission allowing the city to charge an increased fee for providing copies of a birth or death certificate.

Council President Greg Rabb adds that he’s not sure how long it will take for state lawmakers to even view the request, let alone if they would grant approval. The city currently charges $10 for each copy it produces.

HIGGINS APPOINTED TO SUBCOMMITTEE ON CONTERTERRORISM

WASHINGTON – Congressman Brian Higgins has been selected by the House Committee on Homeland Security to serve as Ranking Member of its Subcommittee on Counterterrorism and Intelligence. The Subcommittee on Counterterrorism and Intelligence has jurisdiction over the Department of Homeland Security’s intelligence divisions.

In a press release, Higgins said he is particularly interested in having the opportunity to explore the threat of Hezbollah in the Western Hemisphere, which is an issue of great concern for the Western New York community.

Higgins has been a member of the House Committee on Homeland Security since January 2011.

FORUM ON COUNTY LANDFILL IS TONIGHT

MAYVILLE – The first in a series of Chautauqua County-sponsored public forums on the County Landfill will take place tonight in Ellery. The forums are designed as an effort to discuss issues of concern with local government officials and residents.

The meetings will be conducted by an advisory committee co-chaired by Legislator Vince Horrigan and Department of Public Facilities Director George Spanos. Other members of the committee will include County Legislator Larry Barmore, Ellery Town Councilman Mark Schlemmer, Chautauqua County Planning Board members Mike Rodgers and John Penhollow, and a representative from the Town of Gerry.

The forums will be open to the public and the initial meeting will be held on Tonight  at 7 p.m. at the Ellery Town Hall in Bemus Point.
