U.S. Attorney Trini Ross announced that 51-year old James Tracy received child pornography images, solicited a minor to send him images, and engaged in sexual contact with an underage victim.
Investigators conducting a forensic review of Tracy’s electronics discovered 51 images of child pornography, some which included depictions of violence.

Prior to this investigation, in February 1995 and March 2001, Tracy was convicted of First Degree Sexual Abuse and First Degree Attempted Sexual Abuse. In each of the prior cases, both victims were under the age of 18.

U.S. District Judge Richard Arcara sentenced Tracy to serve 275 months in prison.

The sentencing is the result of an investigation by Homeland Security Investigations, under the direction of Acting Special Agent-in-Charge Matthew Scarpino; the New York State Police, under the direction of Major Eugene Staniszewski; and the Jamestown Police Department, under the direction of Chief Tim Jackson.

The US Attorney’s office in Buffalo said 30-year-old Shane Guay entered his plead in federal court on Wednesday.

Guay was arrested in November 2016 following a multi-agency investigation that included Homeland Security Investigators along with police in Massachusetts, Georgia, and South Africa. During the investigation, authorities learned Guay solicited minor victims through Instagram to produce images of child pornography. A follow up investigation into Guay recovered 587 images and five videos of child porn on electronic devices that he had owned.

Sentencing for Guay is scheduled for April. He faces five to 20 years in prison.

Th U.S. Attorney’s Office in Buffalo says 51 year old Richard Miller of Forestville pleaded guilty this week to receipt and possession of child pornography.  Charges remain pending against Joseph Harvey, also of Forestville.

Assistant U.S. Attorney Jonathan Cantil, who is handling the case, stated that between 2006 and 2009, Miller produced child pornography by filming himself engaged in a sexual act with a minor. Between January 2016 and March 2017, Miller and co-defendant Harvey exchanged images of child pornography and engaged in illicit discussion regarding child pornography and pedophilia. In addition, a search of the residence shared by the defendants revealed multiple electronic devices that contained child pornography.

The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.

The charges carry a minimum penalty of five years in prison, a maximum penalty of 40 years, and a $500,000 fine. Miller will be sentenced in August.

Travis Sanders

BUFFALO – A former city resident and former general manager of a local junior hockey team has been arrested on child pornography charges.

The U.S. Attorney’s office in Buffalo says 32-year-old Travis Sanders was arrested in Texas following a criminal complaint that he allegedly received and distributed child pornography while living in Western New York.

The case was brought to the attention of the department of Homeland Security by the Royal Canadian Mounted Police National Child Exploitation Center.

Canadian authorities claim an individual with the username “Damion Forsberg” was using Skype and regularly shared pornography that sometimes included children. An investigation revealed the individual to allegedly be Sanders and that he was living in Jamestown when the sharing allegedly took place. Authorities seized a laptop and cellphone allegedly belonging to Sanders and say they found images and videos of minors engaged in sexually explicit conduct.

According to the Post-Journal, Sanders is the former general manager and assistant coach of the Southern Tier Xpress junior hockey team in Jamestown. He left Jamestown in July to take a similar job with a team in Teaxas.

Sanders was arrested in Texas and will be extradited to Western New York at a later date to face prosecution.

The charges carry a mandatory minimum penalty of five years in prison, a maximum of 20 years and a $250,000 fine.

Jeffrey Shriver

LAKEWOOD – A Lakewood man who police say was under investigation for rape has additionally been charged with possessing child pornography.

The Chautauqua County Sheriff’s Office on Friday announced the arrest of 38-year-old Jeffrey L. Shriver. The investigation began after a victim came forward to police resulting in the first-degree rape charge Sept. 13.

The sheriff said he could not provide further information regarding the incident that led to the rape charge because the investigation was ongoing.

As a result of a subsequent investigation, Shriver was also charged with four counts of possessing an obscene sexual performance by a child.

Scott Aikens

BUFFALO – A Clymer teacher who was charged last week with Child Pornography has been released from police custody on $50,000 cash bail.

That’s according to a report from the Jamestown Post-Journal, which also says 60-year-old Scott Aikens is required to stay under home confinement until his prosecution plays out.

No immediate hearing has been scheduled and the U.S. Attorney’s Office has until Dec. 18 to bring an indictment.

Aikens was taken into custody Friday after Homeland Security Investigations agents executed a search warrant at his Clymer residence following an investigation that traced a user on child pornography website back to his home address. When agents arrived they reported finding Aikens at a computer with child pornography images on the screen. They also say he admitted to possession videos of child pornography.

Aikens teaches agriculture teacher at Clymer Central School and the school placed him on administrative leave after being notified of the federal charges.

The criminal charge carries a mandatory penalty of 10 years in prison and a $250,000 fine.

BUFFALO – A teacher from the Clymer Central School district in Chautauqua County has been placed on administrative leave after he was arrested and charged with possession of child pornography.

The U.S. Attorney’s Office in Buffalo on Friday reported that Homeland Security Investigations received information that an online username “EJD” was active on an international child pornography website.

The investigators traced the account to 60-year-old Scott Aikens, who is the agriculture teacher at Clymer. A search of his home on Route 474 led to the confiscation of multiple electronic devices and agents allegedly saw pornographic images of children on his computer screen.

Clymer was contacted by the U.S. Department of Homeland Security on Friday and Aikens was placed on administrative leave immediately.

Aikens is being held pending a detention hearing Tuesday.

The U.S. Attorney’s Office in Buffalo says 33 year-old Matthew Bailer has been charged with possession of child pornography.

The charges come after Jamestown Police received a complaint from a parent on July 11 that her two children may have been sexually abused by Bailer. The parent stated that she was told by Bailer’s sister that she found a series of concerning pictures — sexual in nature — on a Nokia cellphone that was used by the Jamestown resident.

Bailer was subsequently arrested on a warrant out of Missouri related to a burglary case. During a search of the Nokia cellphone, investigators found hundreds of images of child pornography.

Bailer made an initial appearance Wednesday in federal court and is being held pending further proceedings.

The charge carries a maximum penalty of 20 years in prison and a $250,000 fine.

The U.S. Attorney’s Office says 36 year-old Steven Fetterman pleaded guilty to the charge in federal court in Buffalo. The charge carries a maximum penalty of 20 years in prison and a $250,000 fine.

The charge stems from an investigation the culminated with an arrest on November 19, 2015. The investigation found Fetterman in possession of 1,720 videos and 13,838 images of child pornography.

Sentencing is scheduled for October.

James Chapman

BUFFALO – A Jamestown man accused of attempting to coerce minors into prostitution and sexual activities waived a hearing for detention earlier this week in U.S. District Court in Buffalo.

The Post-Journal is reporting that 37 year-old James Chapman will remain in federal custody in Buffalo following a 14-count indictment announced last week that includes charges of enticement of a minor; sex trafficking of a minor; production, distribution, possession and receipt of child pornography.

According to federal officials, Chapman allegedly attempted to coerce a minor to engage in prostitution and sexual activity between Nov. 24 and Nov. 25, 2014. On the same dates, he recruited two minors to engage in a commercial sex act. The minors were both 16 years old at the time of the incident. Between December 2016 and April 2017, Chapman is also accused of distributing child pornography depicting the two minors. He also allegedly coerced yet another minor to engage in “sexually explicit conduct for the purposes of producing a visual depiction.”

Chapman is accused of using a Facebook account under the name “Perverted Doe” that contained images of child porn. Investigators say he also used the online alias of Fatz Guy and Perverted Doe.

During the investigation, federal prosecutors say Chapman reportedly made a false statement to the FBI in January of this year.

Chapman was arraigned last week in Federal Court in Buffalo on a 14-count indictment.

The charges carry a mandatory minimum penalty of 15 years in prison, a maximum of life and a $250,000 fine.
