Ellery Town Board Tables Proposed Law Regarding Landfill Expansion

The Chautauqua County Landfill is located off Townline Rd. in the Town of Ellery. The county is seeking the state's permission to expand the landfill by 53 acres to the west. The deadline for public input on the expansion request is Wednesday, March 11, 2015.

ELLERY – The Ellery Town Board has once again tabled a local law concerning the expansion of the county landfill.

That’s according to the Jamestown Post-Journal, which says the decision to table the law for the second month in a row was made on Monday. The proposed law would reportedly prohibit the expansion of the existing landfill and also calls for banning the construction of any new facilities. It also aims to stop fracking waste from entering the landfill.

Currently, Chautauqua County is pursuing a 53-acre landfill expansion in Ellery.

The law was previously tabled after concerns regarding the definition of high-volume fracking waste. Town attorney Neil Robinson sought input from an environmental consultant but said on Monday he felt the consultant didn’t help the town much with tightening up the definitions.

Town boardmember Mark Schlemmer also raised the issue that the town may want to eliminate the first item of the proposed local law, which calls for banning fracking in the town. Additional discussion regarding the local law was tabled until the October board meeting.
