Do know that the Board of Elections does not want to be where it is not wanted. That being said, the answer the NCC received from the NYS BOE was accurate, but was apparently asked by the NCC with it NOT providing all of the details. “No place in which a business licensed to sell alcoholic beverages for on premises consumption is conducted on any day of local registration or of voting shall be so designated,” NYS Election Law.

I don’t think it is splitting hairs at all to say that the Gateway Train Station rotunda, where the gift shop is located, is distinctly separate from the Comedy Karaoke area where on premises beer, wine and canned mixed drinks is being sold. Voters enter the building through the gift shop and have zero access to the Comedy Center. Guests visiting the Comedy Center must enter at the center’s front entry and while possibly are there to vote too, it’s highly unlikely. Once NCC guests have completed their tour, they exit to the gift shop and are not able to re-enter the separate Comedy Center. Voters however enter the separate gift shop and are not able to gain access to the Comedy Center through its locked exit, where the alcohol is served. In conclusion, voting will be elsewhere in the future for Ward 3 voters. We approached City Council for advice and counsel on the location of a new poll site as we are required to do.
